The Planning Commission
is established pursuant to the authority of Section 6-29-310 of the Code
of Laws of South Carolina.
The Planning Commission
shall consist of nine (9) members. At least one (1) attorney and one (1)
design professional (either a registered architect or a registered landscape
architect).
Town Council appoints
members to the Commission. All members shall be appointed for three-year
terms. No member may serve for more than two successive terms, except
for extraordinary circumstances where Council believes it to be in the
best interest of the community to have a continuation for a specified
period of a particular member of the commission.
A majority of the
Commission shall constitute a quorum for the conduct of business.
Public notice of all meetings of the Planning Commission shall be provided
by publication in a newspaper of general circulation in the Town, in accordance
with South Carolina Freedom of Information Act requirements.
The Planning Commission shall have jurisdiction over all lands within
the Town. The Town Council may expand the jurisdiction of the Planning
Commission by ordinance and/or intergovernmental agreement, in accordance
with the provisions of Section 6-29-330 of the Code of Laws of South Carolina.
Powers
and Duties:
The Planning Commission
shall perform the duties and possess the powers as follows:
A. Prepare and periodically revise plans and programs for the development
and redevelopment of its areas as provided in Land Management Ordinance
(LMO).
B. Prepare and recommend for adoption to the Town Council as a means
for implementing the plans and programs in its area:
1. Zoning
ordinances to include zoning district maps and appropriate revisions
thereof;
2. An official map and appropriate revisions of it showing the
exact location of existing or proposed public street, highway and utility
rights-of-way, and public building sites, together with regulations
to control the erection of buildings or other structures or changes
in land use within the rights-of-way, building sites, or open spaces
within its jurisdiction, or a specified portion of it;
3. A landscaping ordinance setting forth required planting, tree
preservation and other aesthetic considerations for land and structures;
4. A capital improvements program setting forth projects required
to implement plans which have been prepared and adopted, including an
annual listing of priority projects for consideration by the governmental
bodies responsible for implementation prior to preparation of their
capital budgets; and
5. Policies or procedures to facilitate implementation of planning
documents.
C. Review and
take action on street names.
D. Review and make recommendations on public projects.
E. Review and take action on certain traffic impact analysis plans.
F. Review and make recommendations to the Town Council in regard
to amendments to the text of the LMO.
G. Review and make recommendations to the Town Council in regard
to amendments to the official zoning map.
H. The Planning Commission may delegate the authority to review
and approve all subdivisions to the Administrator.
Appeal
Appeal from any final
decision of the Planning Commission shall follow the procedures established
in Chapter 3 of the LMO for the specific type of decision. |
